These Terms of Service ("Terms") govern your use of TradePilot's web app at app.gettradepilot.net and iOS app (the "Service"), operated by Tesselex Software Inc., a corporation based in Ontario, Canada. By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 and able to enter a contract. You are responsible for your account, for keeping your credentials secure, and for all activity under your account. Provide accurate information and keep it current.
TradePilot helps trades and service businesses schedule jobs, manage customers, and create and send quotes and invoices. We may add, change, or remove features over time.
New workspaces may receive a free trial (currently 30 days, no card required). Only one free trial is available per email address. When the trial ends, creating/editing/sending is paused until you subscribe; you can still view, export, archive, and delete your data.
You retain all rights to the data you enter (your customers, jobs, quotes, invoices, notes). You grant us a limited licence to host, process, and transmit that content solely to operate and provide the Service to you. You are responsible for your content, for having the right to store it (including information about your customers), and for complying with applicable laws, including obtaining any consents needed to contact your customers by email or SMS.
You agree not to: use the Service unlawfully; send spam or messages recipients have not consented to; infringe others' rights; attempt to breach security or access other users' data; reverse-engineer or disrupt the Service; or resell it without permission. You must honour opt-out requests (e.g., SMS STOP) from your recipients.
The Service integrates with third parties (e.g., Apple, Stripe, Google Maps, Twilio). Your use of those features may be subject to their terms, and we are not responsible for third-party services.
The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that it meets your requirements. TradePilot is not an accounting, tax, or legal service; you are responsible for the accuracy of your quotes, invoices, and tax handling.
To the fullest extent permitted by law, TradePilot and its operator will not be liable for indirect, incidental, special, or consequential damages, or lost profits or data. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim.
You will indemnify TradePilot against claims arising from your content, your use of the Service, or your breach of these Terms.
TradePilot includes an optional SMS feature that lets you send transactional text messages to your own customers — for example appointment confirmations and reminders, quote and invoice notices, payment reminders, and job-completion updates. You may use it only for these service-related purposes (not for marketing or promotional content).
TradePilot enables text messaging to one of your customers only when that customer has opted in through your public TradePilot quote-request form by checking the un-checked consent box, which reads: “I agree to be contacted by [Business] (via TradePilot) about this request by email, phone, or text message — including appointment, quote, invoice, and payment updates. Message frequency varies; msg & data rates may apply. Reply STOP to opt out, HELP for help.”
TradePilot sends these customer messages on your behalf through our messaging provider (Twilio). Every message identifies your business and includes opt-out instructions so recipients can reply STOP to unsubscribe or HELP for help at any time, and standard message and data rates may apply to recipients. STOP requests are honoured automatically.
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or to comply with law. On termination, your right to use the Service ends; sections that by nature should survive will survive.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. Disputes will be subject to the courts located in Ontario, Canada.
We may update these Terms. Material changes will be posted here with a new date; continued use means you accept the updated Terms.
